Chinese companies circumvent NVIDIA chip export ban

The technology war between the US and China continues, with the US continually trying to weaken the Chinese semiconductor industry. Last fall, restrictions on technology sales to China were further tightened. Nevertheless, Chinese companies were recently able to purchase high-end chips from NVIDIA despite the ban. These chips were embedded in server products from Taiwan-based Super Micro Computer, Dell Technologies and Gigabyte Technology.

An examination of tender documents found that 10 Chinese companies, including those with government ties, purchased NVIDIA chips. These companies range from the Chinese Academy of Sciences to technology investment firms to aviation and space centers. The chips were purchased between November 20 and February 28, but it remained unclear whether the sellers were using existing supplies or circumventing export restrictions.

When contacted by Reuters, NVIDIA emphasized that the products listed in the tenders were generally available before the restrictions and did not violate export control regulations. The server manufacturers also assured that they would comply with the law or conduct further investigations. The US Department of Commerce could not comment on possible investigations, but confirmed it was monitoring restricted chips and conducting end-use controls.

Experts such as Daniel Gerkin of the Washington law firm Kirkland & Ellis speculated that NVIDIA chips may have been routed to China without the manufacturer's knowledge. Due to opaque supply chains, it would be difficult for the US government to take action. Despite this controversy, NVIDIA stock saw its price rise in trading.
