Pegs have to come out: villa owner wins in court

In a lengthy dispute between villa owner Burkhart Ceppa and Perfecthaus GmbH before the Ravensburg regional court in Ochsenhausen, Baden-Württemberg, Ceppa finally prevailed. The developer had driven 160 pegs under Ceppa's property without permission to secure a new apartment building. Although Ceppa refused compensation of 290,000 euros, the court ruled that the pegs must be removed.

Perfecthaus GmbH had built a new building on the narrow site and dug a seven meter deep construction pit. According to experts, the apartments on the low-lying ground floor of the new building could be the first to be at risk in the event of a landslide. In order to prevent the neighboring earth wall from collapsing, 160 steel anchors were installed in the slope, which now endanger the house without pegs.

Burkhart Ceppa told BILD that he was primarily concerned with strengthening democracy and not with financial compensation. The public sidewalk between Ceppa's villa and the new building was also damaged as a result of the construction work carried out by Perfecthaus GmbH. The city of Ochsenhausen accepted compensation of 8,000 euros for the damage. Despite the court's decision, the need for new construction remains as housing is urgently needed in the city.

The reaction of the majority of Ochsenhausen's 8,900 residents to the court's decision was mixed. City councilor Hans Holland expressed his incomprehension that the new building had to be demolished because of the pegs. He hopes for an agreement between the parties in order to preserve the living space. The defendant construction company did not comment on the verdict, but is expected to appeal to the Stuttgart Higher Regional Court.
