Black construction dispute: District court dismisses lawsuit against ex-tenant

The Wolfratshausen district court has made a decision in an ongoing case involving three illegal buildings in the Weidach district of Wolfratshausen. At the end of January 2023, the lower building supervisory authority at the district office ordered the demolition of the three single-family houses that were classified as illegal buildings. The client and his daughter appealed against these orders. However, they suffered a defeat at the Wolfratshausen district court, while the administrative court still has to decide on the lawsuits.

The Munich Administrative Court has received a total of seven lawsuits, including three from the owner. The building owner filed a further three lawsuits, while one of the former tenants fought against the toleration order. The demolition orders remain temporarily invalid until the administrative court makes a decision. An exact trial date has not yet been set because older proceedings take precedence.

In a separate legal dispute before the Wolfratshausen district court, the landlord demanded a good 22,000 euros in rent from an ex-tenant. The court dismissed the lawsuit because the amount demanded was reduced due to the tenant's legitimate counterclaims. The case file is now at the Munich II Regional Court, as the plaintiff is expected to file an appeal.

A citizens' initiative is campaigning against the demolition of the black buildings and is demanding that the houses be tolerated. The mayor of Wolfratshausen rejects this due to a lack of building permits. The initiative does not rule out a referendum in order to achieve its goal.
