The Saxony Consumer Center points out that Zalando is allegedly engaging in unlawful behavior by charging defaulting customers a fee of 5.30 euros for the second reminder from October 13, 2023. It encourages consumers who have received such a payment request to join a potential class action lawsuit, as the actual cost of an email reminder is “vanishingly small.”
The new collective action law enables class actions
The new collective action law, which recently came into force, allows class actions in such cases. The consumer advice center checks the applications received and files a lawsuit if enough affected parties come together. Even later joining the class action lawsuit is still possible. This is the first major practical test for the new legal action option, and small amounts in particular, such as in this case, can now be examined in bulk.
