Model lawsuit against Stromio: Hope for compensation in the event of an energy crisis
In the winter of 2021/2022, some electricity customers suddenly found themselves without an electricity provider when electricity prices rose massively. Among the providers who had difficulty adhering to the agreed conditions was the provider Stromio, which then terminated contracts. The Hesse consumer advice center considers this procedure to be unlawful and has filed a model declaratory action against Stromio. Former customers of the provider have the opportunity to join this lawsuit in order to hope for compensation if the case is successful.
In order to make use of this option, injured parties must register free of charge in the lawsuit register at the Federal Office of Justice. According to the Hesse consumer advice center, they have until May 27, 2024 to do this before the oral hearing begins. The consumer advocates advise those registered to precisely document the damage caused in order to calculate the difference between the prices they pay for the replacement or basic supply or with another electricity provider and the agreed Stromio prices for the contract term.
The head of the legal enforcement specialist group at the Hesse Consumer Center, Kerstin Wolf, explains how the damage caused can be roughly calculated. It is recommended that the amount of damage be recorded precisely in order to be adequately compensated in the event of success.
