Consumer advice centers are preparing a class action lawsuit against Primaholding subsidiaries for violating the right of withdrawal - financial expert informed

According to reports, the energy provider Primaholding is once again in trouble with consumer advocates. The Federal Association of Consumer Organizations (VZBV) is planning a class action lawsuit against the subsidiaries Primastrom, Nowenergy and Voxenergie. The VZBV accuses electricity and gas providers, among other things, of not adequately informing customers about their right of withdrawal. Last year, consumer advice centers received a total of 17,000 complaints against Primaholding subsidiaries.

According to the VZBV, customers of Primastrom, Nowenergy and Voxenergie could revoke their contracts within 12 months and 14 days after conclusion of the contract and demand a refund of all contributions already paid. The consumer advocates also accuse the companies of other violations, such as a lack of termination options in the event of price increases or illegal regulations regarding the contract term.

In addition to the current allegations of inadequate cancellation instructions, model declaratory actions are already pending against Primastrom and Voxenergie due to inadmissible price increases. The first oral hearing in this matter is scheduled to take place on November 23rd at the Berlin Court of Appeal.

These new developments could have a significant impact on the energy market and consumers. Customers who have previously concluded contracts with Primastrom, Nowenergy or Voxenergie could now terminate or revoke their contracts and possibly demand back payments that have already been made. In addition, the VZBV class action lawsuit opens up the possibility that a large number of consumers will join, which could result in high financial burdens for Primaholding and its subsidiaries.
