Car crashes into pharmacy: cyclist seriously injured – who pays now?
A serious car accident occurred in front of the Sonnen-Apotheke late Tuesday afternoon. An elderly driver took a curve too freely and collided with an oncoming cyclist. She was dragged all the way to the pharmacy window, whereupon her leg became trapped between the car and the window, causing significant injuries. The incident not only caused injuries, but also caused great concern for the pharmacist, Ms. Saalfelder.
After the cyclist initially lay injured on the ground, the driver maneuvered her vehicle and damaged the pharmacy's window again. Surprisingly, the driver was not aware of any guilt and apologized neither to the injured cyclist nor to Ms. Saalfelder.
The reaction on site
In the critical situation, the pharmacy team stepped into the breach to provide first aid to the cyclist and the concerned passers-by, while the emergency services were called. Ms. Saalfelder was visibly concerned about the stability of the broken window and the possibility that it could implode. It also turned out that the landlord viewed the damage to the facade as a tenant's matter, which meant additional stress for Ms. Saalfelder.
The driver's insurance will cover the costs of the damage except for a deductible. Nevertheless, the organization remains with Ms. Saalfelder, which further complicates the situation for her. Even though the window has been damaged, the frame must first be inspected by the landlord before a glass fitter can be hired.
The legal steps after an accident
In such accident scenarios, there is also important legal information that can help both those injured and those responsible. ADAC lawyers recommend seeing a doctor immediately to have injuries documented and advise not to sign anything that is not fully understood. It is recommended that you inform your own insurance company about the incident and do not sign blanket declarations of assignment. ADAC members in particular can access a free initial consultation to assert their claims, which is particularly helpful, as well ADAC emphasized.
In the case of accidents that are not their fault, the opposing insurance company bears the legal fees, and injured parties can assert their claims for damages directly from the motor vehicle liability insurance of the other party involved in the accident. For individual types of damage, be it a total loss or minor repair costs, there are different rules for reimbursement, including the possibility of using a rental car if the vehicle is not roadworthy.
The events in front of the Sonnen-Apotheke not only illustrate the effects of a traffic accident, but also the associated organizational and legal challenges. Ms. Saalfelder was finally able to go home after the situation had been clarified, but the worries and questions still remain.
