More and more criminals are targeting bank accounts. The methods used by perpetrators are becoming increasingly professional and vary greatly. Unfortunately, most of those affected are often powerless because the money is often irrevocably lost after a fraud. The NDR reported that the current discussion also includes the responsibility of customers for such fraud. Detecting fraud attempts is becoming increasingly difficult for consumers, exacerbating the problem.
In a detailed investigation by the Plusminus team, new fraud schemes were presented and ways in which banks could better protect their customers were discussed. Court rulings on online banking fraud
A series of judgments on liability disputes in online banking fraud show further dimensions of the problem. Claims for damages were often decided in favor of customers if no gross negligence could be proven. So reported Test.de of different cases:
- Im Fall eines Kunden der Volksbank, der 17.010 Euro verlor, wurde die Bank verpflichtet, den Betrag zu erstatten, nachdem das Landgericht Hannover entschied, dass keine grobe Fahrlässigkeit vorlag (Urteil vom 30.01.2025, Aktenzeichen: 4 O 62/24).
- Ein Kunde der Genossenschaftsbank, der 6.700 Euro verlor, erhielt ebenfalls sein Geld zurück, da das Landgericht Darmstadt zu Gunsten des Kunden entschied (Urteil vom 31.01.2025, Aktenzeichen: 2 O 290/24).
- In einem weiteren Fall registrierten Betrüger das Smartphone eines DKB-Kunden für Buchungen, was zu einem Verlust von über 45.000 Euro führte. Auch hier wurde die Bank zur Erstattung verurteilt (Urteil vom 14.08.2024, Aktenzeichen: 38 O 269/23).
These judgments are just a few examples that show that in many cases the legal situation is decided in favor of consumers unless banks can prove that their customers acted with gross negligence.
