Air passenger rights: How to secure compensation for delays!

As part of a nationwide mobile phone measurement week, users have the opportunity to determine the quality of mobile networks in Germany. This initiative is intended to help gain an overview of network coverage and performance and identify possible improvements. Meanwhile, the issue of passenger rights is also in focus, especially given the frequent flight delays that can cause passengers not only inconvenience but also financial compensation.

Passengers whose booked flight arrives more than three hours late are entitled to compensation, which can range between 125 and 600 euros, depending on the route. This is part of the Air Passenger Rights Regulation (VO (EC) No. 261/2004), which regulates the rights of airline customers in the European Union. The regulation applies to all flights from an EU airport, regardless of the airline. For flights from third countries to EU airports, these rights only apply if the airline is based in the EU, reports the consumer advice center.

Claims for delays and cancellations

The amount of compensation payments varies depending on the flight route and the duration of the delay. In the event of an arrival delay of at least three hours, passengers will receive:

  • 250 Euro für Flüge von 1.500 km oder weniger
  • 400 Euro für Flüge von mehr als 1.500 km innerhalb der EU oder zwischen 1.500 und 3.500 km
  • 600 Euro für Flüge über 3.500 km

In addition, passengers have the right to support services in the event of departure delays, which, depending on the distance, can also include meals and, if necessary, hotel accommodation. If the departure is delayed by at least five hours, passengers also have the option of a full refund of the flight price.

However, there are expectations in the aviation industry that fewer passengers will receive compensation in the future. President Reinicke emphasized that the industry's growth should continue in the coming years. He is up for re-election at the general meeting in Berlin, which could potentially influence the future of air passenger rights in Germany.

Growing awareness of air passenger rights

The regulation not only regulates claims in the event of delays, but also compensation in the event of flight cancellations or overbooking. Passengers can make a claim if the airline has not informed them of the cancellation in good time - more than 14 days before the scheduled departure. Extraordinary circumstances can also exclude a claim for compensation.

Despite the challenges in the airline industry, the package of measures to support travelers stipulates that passengers affected by delays can use sample letters to assert their claims. This makes it easier for those affected to enforce their rights. These measures and regulations are part of the legal framework that is intended to ensure that airlines live up to their responsibilities towards passengers.
