The tenant rejected the payment obligation because he did not notice the defect. He argued that it was the landlord's responsibility to check the water pipes regularly. However, the Hanau District Court decided that the tenant was obliged to pay because he had noticed the defect and failed to report it. This decision was confirmed by the Hanau Regional Court on appeal. It was recognized that the tenant must regularly check the rental property for defects, even if he is away frequently.
